Judge Says Alabama Death Penalty Unconstitutional

Death penalty tossed-out. A judge in Jefferson County says the way Alabama handles death cases i not constitutional. So she would not allow capital punishment to be considered in the case of four men charged with murder. Judge Tracie Todd says that the Supreme Court has ruled that juries have to impose death — not judges.

In Alabama — a jury recommends — but judges have the final say as to whether a defendant lives or dies.
